Traffic Offence Case Study – Careless Driving and Fail to Stop

The Charges

Our client was facing the following charges:

  • Careless Driving; and
  • Fail to stop and give way.

Our client had no criminal or traffic priors at the time of the offending.

 

What the police alleged

Our client allegedly caused a motor vehicle accident after failing to stop at a stop sign. The two Complainants received minor injuries in the accident.

 

How Nardi Lawyers helped

Our client accepted responsibility for the accident from the onset and intended on pleading guilty. Our primary objective was to ensure that our client kept their licence, given that the Court has discretion in suspending an individual’s licence in Careless Driving cases.

During negotiations with the Prosecution, we argued that the charge of fail to stop and give way be withdrawn as the Careless Driving charge adequately covered the incident. This was accepted.

As with any plea of guilty, our lawyers spent quality time in conference with the client to ensure that our preparation was perfect, and all the relevant information and personal circumstances were noted.

 

Outcome

Our client pleaded guilty to one charge of Careless Driving.

In Court, we tendered character references and gave submissions on our client’s behalf which were carefully constructed following our interviews with the client.

Our client was sentenced to an Undertaking to be of good behaviour for a period of 12 months without conviction

Our client did not receive a suspension of their driver’s licence. We were very pleased that we achieved our client’s desired outcome.
