The Charges
Our client was facing the following charges:
- Traffick Cocaine;
- Possess Cocaine;
- Possess Cannabis;
- Possess Controlled Weapon;
- Deal Property Suspected Proceeds of Crime; and
- Commit Indictable Offence Whilst on Bail.
Our client had limited criminal priors at the time of the offending.
What the police alleged
Our client was allegedly in possession of cocaine with the intent to traffick, cannabis, a controlled weapon and cash which was suspected to be proceeds of crime. Our client was charged with these offences whilst on bail. Our client was with another individual at the time the incident occurred.

During negotiations with Prosecution, Nardi Lawyers raised a significant number of legal issues, which were raised after careful and detailed analysis of the evidence provided.
The matter did not resolve at the first mention, as the Prosecution requested further time to make enquiries following the issues we raised with their evidence. The matter was subsequently adjourned to a Contest Mention.
Prior to the Contest Mention hearing, further negotiations took place, with the following charges being withdrawn by the Prosecution:
- Traffick Cocaine;
- Possess Cocaine;
- Possess Controlled Weapon; and
- Deal Property Suspected Proceeds of Crime.
Outcome
In Court, we tendered character references, psychologist reports and gave submissions on our client’s behalf.
Our client was sentenced to a fine without conviction.
This was an outstanding outcome, given that our client had engaged us in a much more serious position.
